The trial of Maya Hernandez, a 20-year-old Visalia mother accused of leaving her children inside a hot car while she underwent a cosmetic procedure, entered its third day Wednesday with emotional testimony from a forensic pathologist and detectives.
Hernandez is charged with child endangerment after authorities say she left her two young children in her vehicle outside a Bakersfield medical spa, where she was scheduled for a lip-filler injection. One of the children, 1-year-old Amillio Gutierrez, later died.
Forensic pathologist explains cause of death
The forensic pathologist testified that Amillio died from heat stroke and ruled the manner of death an accident.
“I chose accident because there was no intent to harm the child,” the pathologist said, noting that extreme heat caused the toddler’s brain and lungs to swell.
According to testimony, Amillio’s internal temperature reached 107 degrees, far above the 104-degree level where the body begins to fail. The Kern County Coroner’s Office previously confirmed the cause of death as heat stroke.
Prosecution emphasizes Hernandez’s decisions
Prosecutors argued that Hernandez’s actions ultimately led to her child’s death.
“We are here because of choices,” prosecutors said. “Choices to leave her children in the car. Choices to put her appearance before her children.”
During opening statements Monday, the prosecution outlined its theory that Hernandez knowingly left her children in conditions that proved deadly.
Video and detective testimony
Video presented in court showed Hernandez sitting in the spa’s waiting room, frequently checking her Apple Watch and appearing alone, with no children or stroller in sight.
A detective later testified that a stroller located in the trunk of Hernandez’s vehicle could have been used to safely bring the children inside.
Trial continues
The court will continue reviewing testimony and evidence as the trial progresses. Further witnesses are expected to take the stand in the coming days.
